Pursuant to the Law on Organization of the Government dated February 18, 2025;

Pursuant to the Law on Protection of State Secrets dated November 15, 2018;

Căn cứ Luật Bảo vệ bí mật nhà nước ngày 15 tháng 11 năm 2018;

DECIDES:

Article 1. State secrets of Top Secret level include:

Điều 1. Bí mật nhà nước độ Tuyệt mật gồm:

Information about special science, technology, and innovation tasks or special national science, technology, and innovation programs directly serving national defense and security, which are decisive to the country's defensive combat capabilities and the protection of the Fatherland, including:

Thông tin về nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo đặc biệt hoặc chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia đặc biệt phục vụ trực tiếp cho quốc phòng, an ninh có ý nghĩa quyết định khả năng tác chiến phòng thủ đất nước, bảo vệ Tổ quốc, gồm:

1. Programs, explanations, progress reports, synthesis reports, result reports, products.

1. Chương trình, thuyết minh, báo cáo tiến độ, báo cáo tổng hợp, báo cáo kết quả, sản phẩm.

2. Appraisal reports, approval Decisions, task assignment contracts.

2. Báo cáo thẩm định, Quyết định phê duyệt, hợp đồng giao nhiệm vụ.

3. Other documents and materials related to the process of formulation, approval, implementation organization, evaluation of results, efficiency, and impact on tasks and programs.

3. Các văn bản, tài liệu khác liên quan đến quá trình xây dựng, phê duyệt, tổ chức triển khai, đánh giá kết quả, hiệu quả và tác động đối với nhiệm vụ, chương trình.

Article 2. State secrets of Secret level include:

Điều 2. Bí mật nhà nước độ Tối mật gồm:

Information about special science, technology, and innovation tasks or special national science, technology, and innovation programs that have a direct impact on national defense and security; protection of national sovereignty, except for the contents specified in Article 1 of this Decision, including:

Thông tin về nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo đặc biệt hoặc chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia đặc biệt có tác động trực tiếp đến quốc phòng, an ninh; bảo vệ chủ quyền quốc gia trừ các nội dung quy định tại Điều 1 Quyết định này, gồm:

1. Programs, explanations, progress reports, synthesis reports, result reports, products.

1. Chương trình, thuyết minh, báo cáo tiến độ, báo cáo tổng hợp, báo cáo kết quả, sản phẩm.

2. Appraisal reports, approval Decisions, task assignment contracts.

3. Other documents and materials related to the process of formulation, approval, implementation organization, evaluation of results, efficiency, and impact on tasks and programs.

Article 3. State secrets of Confidential level include:

Điều 3. Bí mật nhà nước độ Mật gồm:

1. Reports, Submissions, documents seeking opinions on new guidelines and policies related to science, technology, innovation, and digital transformation activities serving national defense and security; except for the contents specified in Article 1 and Article 2 of this Decision.

1. Báo cáo, Tờ trình, văn bản xin ý kiến về chủ trương, chính sách mới liên quan đến hoạt động khoa học, công nghệ, đổi mới sáng tạo, chuyển đổi số phục vụ quốc phòng, an ninh; trừ các nội dung quy định tại Điều 1, Điều 2 Quyết định này.

2. Strategies, master plans, plans, and coordination programs between the Ministry of Science and Technology and the Ministry of National Defense and the Ministry of Public Security with contents serving national defense and security.

2. Chiến lược, quy hoạch, kế hoạch, chương trình phối hợp hoạt động giữa Bộ Khoa học và Công nghệ với Bộ Quốc phòng và Bộ Công an có nội dung phục vụ quốc phòng, an ninh.

3. Information about science, technology, and innovation tasks or national science, technology, and innovation programs, science, technology, and innovation programs of ministries, ministerial-level agencies, government-attached agencies, other central agencies, and provincial People's Committees with contents on national defense and security; territorial sovereignty, human rights; religion, ethnicity; socio-economics, and particularly important health matters affecting the interests of the nation and the people, including:

Thông tin về nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo hoặc chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia, chương trình khoa học, công nghệ và đổi mới sáng tạo của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, cơ quan khác ở trung ương và Ủy ban nhân dân cấp tỉnh có nội dung về quốc phòng, an ninh; chủ quyền lãnh thổ, nhân quyền; tôn giáo, dân tộc; kinh tế - xã hội, y tế đặc biệt quan trọng ảnh hưởng đến lợi ích quốc gia dân tộc, gồm:

a) Programs, explanations, progress reports, synthesis reports, result reports, products.

4. Information about inventions serving national defense and security or having particularly important significance for socio-economic development, including:

4. Thông tin về sáng chế phục vụ quốc phòng, an ninh hoặc có ý nghĩa đặc biệt quan trọng đối với phát triển kinh tế - xã hội, gồm:

a) Patent registration declarations, patent descriptions, and patent abstracts in patent applications.

a) Tờ khai đăng ký sáng chế, bản mô tả sáng chế, bản tóm tắt sáng chế trong đơn đăng ký sáng chế.

b) Patent protection certificates.

b) Văn bằng bảo hộ sáng chế.

c) Exchange documents during the process of appraising patent applications and appraisals related to patent protection certificates with contents on technical solutions of the invention.

c) Văn bản trao đổi trong quá trình thẩm định đơn đăng ký sáng chế, thẩm định liên quan đến văn bằng bảo hộ sáng chế có nội dung về giải pháp kỹ thuật của sáng chế.

5. Information on atomic energy, radiation safety, and nuclear safety:

5. Thông tin về năng lượng nguyên tử, an toàn bức xạ và hạt nhân:

a) Documents seeking approval of the policy on the construction of nuclear facilities.

a) Văn bản xin ý kiến chấp thuận chủ trương về việc xây dựng cơ sở hạt nhân.

b) Explanations, design drawings, and estimation dossiers for categories of nuclear facility security assurance systems (except for design explanations, design drawings, and estimation dossiers that the parties participating in the project agree not to protect as state secrets).

b) Thuyết minh, bản vẽ thiết kế, hồ sơ dự toán đối với hạng mục hệ thống bảo đảm an ninh cơ sở hạt nhân (trừ thuyết minh thiết kế, bản vẽ thiết kế, hồ sơ dự toán được các bên tham gia dự án thống nhất không bảo vệ bí mật nhà nước).

c) Security assurance plans for nuclear facilities.

c) Kế hoạch đảm bảo an ninh của cơ sở hạt nhân.

d) Security assurance plans in the receipt, transport, use, and storage of nuclear fuel, spent nuclear fuel; nuclear materials; group 1 radioactive sources.

d) Kế hoạch đảm bảo an ninh trong giao nhận, vận chuyển, sử dụng, lưu giữ nhiên liệu hạt nhân, nhiên liệu hạt nhân đã qua sử dụng; vật liệu hạt nhân; nguồn phóng xạ nhóm 1.

đ) Plans, options, and reports on the results of responding to radiation incidents, nuclear incidents, and transboundary radiation incidents; radiation monitoring data in radiation incidents, nuclear incidents, and transboundary radiation incidents; drills plans for responding to transboundary radiation incidents.

đ) Kế hoạch, phương án, báo cáo kết quả ứng phó sự cố bức xạ, sự cố hạt nhân, sự cố phóng xạ xuyên biên giới; số liệu quan trắc phóng xạ trong sự cố bức xạ, sự cố hạt nhân, sự cố phóng xạ xuyên biên giới; kế hoạch diễn tập ứng phó sự cố phóng xạ xuyên biên giới.

e) International cooperation programs, plans, and projects on nuclear fuel and nuclear materials.

e) Chương trình, kế hoạch, dự án hợp tác quốc tế về nhiên liệu hạt nhân, vật liệu hạt nhân.

6. Documents on radio frequency allocation for national defense and security purposes; exchange documents between the Ministry of Science and Technology and the Ministry of National Defense and the Ministry of Public Security on handling harmful interference of frequencies directly serving national defense and security tasks; projects and exchange documents on determining frequency areas to serve the implementation of tasks to ensure Vietnam's security and safety.

6. Văn bản về phân bổ tần số vô tuyến điện phục vụ mục đích quốc phòng, an ninh; văn bản trao đổi giữa Bộ Khoa học và Công nghệ với Bộ Quốc phòng, Bộ Công an về xử lý nhiễu có hại tần số phục vụ trực tiếp cho nhiệm vụ quốc phòng, an ninh; đề án, văn bản trao đổi về xác định khu vực tần số phục vụ triển khai nhiệm vụ bảo đảm an ninh, an toàn của Việt Nam.

7. Technical design of private telecommunications networks serving Party and State agencies; frequencies, call signs, and communication conventions of the Special Telegraph Network.

7. Thiết kế kỹ thuật của mạng viễn thông dùng riêng phục vụ các cơ quan Đảng, Nhà nước; tần số, hô hiệu, quy ước liên lạc của Mạng điện báo Hệ đặc biệt.

8. Technical design of important telecommunications works related to national security.

8. Thiết kế kỹ thuật các công trình viễn thông quan trọng liên quan đến an ninh quốc gia.

Article 4. Implementation effectiveness

Điều 4. Hiệu lực thi hành

This Decision takes effect from the date of signing and replaces Decision No. 1294/QĐ-TTg dated August 24, 2020, of the Prime Minister on promulgating the list of state secrets in the field of science and technology and Clause 1, Clause 2, and Clause 3, Article 1 of Decision No. 2238/QĐ-TTg dated December 29, 2020, of the Prime Minister on promulgating the list of state secrets in the field of information and communications.

Quyết định này có hiệu lực thi hành kể từ ngày ký và thay thế Quyết định số 1294/QĐ-TTg ngày 24 tháng 8 năm 2020 của Thủ tướng Chính phủ về việc ban hành danh mục bí mật nhà nước trong lĩnh vực khoa học và công nghệ và khoản 1, khoản 2, khoản 3 Điều 1 Quyết định số 2238/QĐ-TTg ngày 29 tháng 12 năm 2020 của Thủ tướng Chính phủ ban hành danh mục bí mật nhà nước trong lĩnh vực thông tin và truyền thông.

Article 5. Responsibility for implementation

Điều 5. Trách nhiệm thi hành

1. The Minister of Science and Technology shall preside over and coordinate with the Minister of Public Security to be responsible for guiding and inspecting the implementation of this Decision.

1. Bộ trưởng Bộ Khoa học và Công nghệ chủ trì, phối hợp với Bộ trưởng Bộ Công an chịu trách nhiệm hướng dẫn, kiểm tra việc thi hành Quyết định này.

2. Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, and Chairmen of People's Committees of provinces and centrally run cities are responsible for implementing this Decision.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương chịu trách nhiệm thi hành Quyết định này.
